Build Your Own 'BoxVolkswagen' Promotion Terms and Conditions

Please read these terms and conditions carefully.  These terms and conditions ("Terms") apply to the Build Your Own 'BoxVolkswagen' promotion (the "Promotion").  The Promotion contains both a competition and prize draw.

You will be legally bound by these Terms from the time you submit an entry for the Promotion.

If there is a conflict in these Terms with any other terms whatsoever attached to any other advertising material in respect of the Promotion, these conditions will take precedence.  

Opening and closing dates, eligibility

1. The Promotion will begin at 00:01 on 1 December 2024 and end at 23:59 on 31 December 2024 (the "Promotion Period").

2. The Promotion is open to all individuals who:

  • are residents of UK; 
  • are aged between 25 and 70 years old; and
  • hold a current UK or EU driving licence (held for a minimum of three (3) years, with no more than six (6) penalty points),

    at the time of entry into the Promotion.

3. The Promotion is not open to employees of Volkswagen Group United Kingdom Limited, their agents or contractors, Volkswagen Group brand retailers and anyone else connected with the Promotion or to their immediate family members or persons living in the same household, whether or not related, or anyone else otherwise professionally connected with the Promotion.

4. There is no entry fee and no purchase necessary to enter this Promotion.

5. The Promoter reserves the right to verify the eligibility of any participant.  The Promoter may require such information as it considers reasonably necessary for this purpose.

How to enter

6. To enter the Promotion, you must:

  • use and transform a carboard box into your own vision of the Volkswagen ID. range (a "BoxVolkswagen"); and
  • visit linkstre.am/BoxVolkswagen and complete the online form providing the details requested (including uploading an image of the BoxVolkswagen),

    during the Promotion Period.

7. To create the BoxVolkswagen, you can use any cardboard box and other materials although we encourage you to use recycled and recyclable materials and if the box or other materials are branded, then you must cover/obscure the branding as part of your design and before submitting your entry. The more creative, the better.

8. The BoxVolkswagen can be created by any individual, but:

  • where the BoxVolkswagen is created by a child aged under 18, their BoxVolkswagen must be submitted by a parent or guardian (aged between 25 and 70); and
  • where the BoxVolkswagen is created by an individual aged (i) between 18 and 24 (inclusive) or (ii) over 70, their BoxVolkswagen must be submitted by an eligible individual with the creator's express permission and that permission must be confirmed in writing.

9. It is the eligible individual who enters the Promotion who will be eligible to win a prize (not necessarily the person who created the BoxVolkswagen, if the two are different individuals).

10. Only one (1) entry per person. Multiple entries or entries made through agents, third parties, organised groups or any entry duplication method will not be accepted.

11. The Promoter reserves the right to exclude any entrant from the Promotion in the event of a rule being breached.

12. Internet access and an email address are required to enter the Promotion.  

13. Your entry must be completed correctly and be received during the Promotion Period to be eligible for the Promotion.

16. Conditional on your compliance with these terms and conditions, the Promoter grants you a non-exclusive, non-transferable, non-sublicensable licence to display and use the Logo solely on your BoxVolkswagen creations and in images of those BoxVolkswagen creations which are captured and shared for the purposes of entry into this Promotion.

17. No other rights or licences are conferred upon your pursuant to these Terms and you are not entitled to use any other logos, trade marks or brands owned by the Promoter.

18. You shall:

  • not use the Logo in any manner that implies a relationship or affiliation with, sponsorship, endorsement or support by the Promoter beyond simply participation in the Promotion;  
  • not act in any way or display, use or depict the Logo in any way that (in the Promoter's opinion) may denigrate, disparage, tarnish, dilute, misrepresent, erode or otherwise adversely affect or damage, take advantage of, or diminish the value or validity, the reputation, or goodwill associated with the Volkswagen brand or the Promoter;
  • shall not use the Logo in any way that is misleading, unfair, defamatory, infringing, libelous, disparaging, obscene or otherwise objectionable to the Promoter;
  • without limitation, not use the Logo for any commercial or business purposes; and
  • not use the Logo for any other purpose (i.e. over and above your entry into the Promotion).

19. You acknowledge and agree that (a) the Logo has been made available to you free-of-charge under these Terms, (b) you have no rights in or to the Logo, and (c) the Promoter and/or its group companies and/or licensors are the owner of the Logo.   Nothing in these Terms shall affect this.

20. The Promoter reserves the right to terminate the licence to display and use the Logo at any time on written notice. On termination, entrants must cease all use of the Logo and immediately remove any post(s) featuring the Logo from their social media.

Entry

21. You must ensure that your entry:

  • does not include any images of people (including yourself);
  • is either (i) your own original work or (ii) the original work of the individual whose BoxVolkswagen you are submitting in accordance with paragraph 8;
  • does not infringe any third party rights (including without limitation copyright, rights in trade mark, moral rights, rights of privacy/publicity or any other intellectual property rights);
  • does not refer to or compare competitor products;
  • is not defamatory or disparaging about the Promoter, its products or any other people, products or companies;
  • does not include any brands, logos, trade marks or branded products (other than the Logo);
  • is not violent, obscene or offensive;
  • does not depict illegal drugs, tobacco, firearms/weapons, or any activities that may appear unsafe or dangerous or illegal;
  • is responsible and does not damage the Promoter's reputation or place the Promoter in breach of advertising code rules (as determined by the Promoter in its sole discretion);
  • is not sexually explicit or suggestive;
  • is in compliance with the rules, policies and terms of service of the platform where the entry is posted (i.e. StoryStream); and
  • is otherwise suitable for presentation in a public forum (as determined by the Promoter in its sole discretion).

22. Entries which, in the Promoter's opinion may be deemed offensive, discriminatory, inappropriate, defamatory or which are unlawful or in breach of these Terms will not be accepted and will be disqualified.

23. The Promoter reserves the right to disqualify any entrant it believes not to be participating within the spirit of the Promotion or suspects of participating in any unfair or unjust behaviour.  The Promoter reserves the right to use its discretion in all respects and to enforce any penalty or sanction it deems appropriate.

24. You understand that you are solely responsible for compliance with the rules, policies and terms of service of StoryStream.

25. Entries that are not submitted in accordance with these Terms and/or that are delayed, damaged, incomplete, altered, illegible or otherwise defective or which the Promoter cannot identify due to your entry being removed or filtered from search or the suspension or termination of your account will be disqualified.

26. The Promoter accepts no responsibility for entries that are illegible or lost, delayed, damaged or rendered invalid for any reason beyond its control.  

27. Any questions, comments or complaints regarding this Promotion should be directed to the Promoter and not to StoryStream.

28. This Promotion is run by the Promoter. This Promotion is in no way sponsored, endorsed or administered by, or associated with StoryStream.

29. If at any time you wish to withdraw from the Promotion your request should be made in writing to Volkswagen CRM Team, Volkswagen Group UK Ltd, Yeomans Dr, Blakelands, Milton Keynes MK14 5AN.

30. By submitting your entry, you:

  • grant to the Promoter, a perpetual, non-exclusive, royalty-free, worldwide, irrevocable, transferable and sub-licensable licence to use, modify and reproduce use the image(s) shared as part of such entry; 
  • grant the Promoter the right to edit, alter, copy or create derivative works from the image(s) shared as part of such entry (including, without limitation, by adjusting colours, applying filters or using other photo editing techniques or by editing, adapting or translating copy);
  • agree that the Promoter may (but is under no obligation to) use the image(s) shared as part of such entry around the world in marketing and for commercial purposes and that you are not entitled to any fee, commission or payment in connection with that use; and
  • waive all moral rights, contained within your entry and in whatever form, including but not limited to within any: idea; concept; invention; improvement; text; design or image.  If you cannot legally waive your moral rights, then you agree not to assert them in connection with Volkswagen's use of your entry.  

31. Where you have submitted the BoxVolkswagen of another individual in accordance with paragraph 8, you confirm that you have their permission to grant the licences and waive moral rights as set out in paragraph 30.  

32. You will promptly enter into such documents and perform such acts as may be requested by the Promoter for the purpose of giving full effect to paragraph 30.

Selection of the Winner, notification

The Competition

33. All entries will be reviewed by a panel of judges on the basis of ingenuity and creativity and twenty (20) will be shortlisted (the "Competition Shortlist").  

34. One (1) winner will be selected as the ultimate winner (the "Competition Winner").   

35. The Competition Shortlist and Competition Winner will be selected within seven (7) days of the end of the Promotion Period.  

Supplementary Prize Draw

26. A further two hundred and thirty (230) entries will be selected at random by software, from all valid and eligible entries received (excluding the entries that form part of the Competition Shortlist) (the "Prize Draw Winners").

37. The Prize Draw Winners will be selected within seven (7) days of the end of the Promotion Period.  

Winner notification

38. Entries who have not won a prize will not be notified.  

39. All winners (i.e. those on the Competition Shortlist, the Competition Winner and the Prize Draw Winners) will be notified by email by 6 January 2025.  The notification will ask the winner to confirm their compliance with these Terms.

40. If a prize is unclaimed after reasonable efforts have been made to contact a winner, the Promoter will be entitled to dispose of the relevant prize as it sees fit without any liability to the winner for having done so.  These Terms will comply to any such replacement winner.

41. One (1) prize per person.  In the event that the same entrant’s name is drawn for a second or third Prize, another entrant’s name will be drawn until a different entrant’s name is chosen.

Prizes

42. Each of the Competition Winner, the Competition Shortlist and the Prize Draw Winners will win a £15 voucher Planet Junko (the "Voucher").

43. The Competition Winner will win the use of an ID.4 Match Pro (77kWh battery 286PS 1-speed automatic 5 Door) for two (2) weeks (the "Main Prize").

44. The Main Prize is subject to the following terms and conditions:

  • the Competition Winner will be required to enter into a loan agreement with the Promoter.  Use of the vehicle will be subject to the terms of that loan agreement;
  • the two (2) week period shall take place between 13 January 2025 and end 3 February 2025;
  • the prize includes a contribution of up to £100 towards electric charging costs.  The Promoter will provide the Competition Winner with a pre-paid Master Card.  The Master Card is subject to terms and conditions, see https://theirperfectgift.co.uk/terms/Opens an external link;
  • use of the ID.4 Match Pro shall be made solely within the United Kingdom, under standard driving conditions (i.e. not off-road), up to a maximum mileage of 2,000 miles and only for personal (as opposed to business) purposes;
  • the Promoter shall liaise with the Competition Winner and the Competition Winner agrees to provide reasonable assistance, including providing their UK address(es) to which the vehicle shall be delivered on or after 13 January 2025 and collected on or before 3 February 2025 (the total duration of the usage being a two (2) week period), and the times of such delivery and collection. In the event such agreement cannot be reached by the aforementioned deadline, the Promoter reserves the right to change the dates of the period;
  • the Promoter shall be responsible for insuring the vehicle featured in the Main Prize for the duration of the two (2) week usage period, as well as for arranging the delivery and collection of the vehicle to/from the address(es) agreed with the Competition Winner (including any costs associated with such delivery and collection).  The insurance provided will cover the Competition Winner only;
  • the Main Prize does not include any costs not specifically mentioned;
  • upon delivery of the Main Prize vehicle, the Competition Winner shall inspect the vehicle and note any defects or discrepancies on a 'Vehicle Movement Record', to be signed by the delivery driver and the Competition Winner. Any such noted defects or discrepancies shall be rectified by the Promoter and the Competition Winner shall not be responsible for those defects and discrepancies;
  • title in the vehicle comprising the Main Prize will remain with the Promoter at all times. The Competition Winner shall not offer to sell, assign, lease, mortgage, charge encumber or part with possession or otherwise deal with the vehicle nor create or allow any lien over the vehicle. Any breach of this paragraph shall entitle the Promoter to terminate the usage period and recover the vehicle with immediate effect;
  • any loss or proven damage or injury to the vehicle comprising the Main Prize or any person using it or to any person as a consequence of the vehicle or its use, shall be at the Competition Winner's sole risk. The Competition Winner shall be fully responsible for all proven damage to the vehicle incurred whilst in the Competition Winner's possession. The Promoter may, in the Promoter's absolute discretion and with no obligation, choose to assist with any necessary repairs to the vehicle. The Promoter must be informed immediately of any accident, theft or any damage whatsoever caused to the vehicle or any part of it;
  • the vehicle comprising the Main Prize shall be covered for breakdown assistance and roadside recovery services. In the event this service is required, the Competition Winner should contact the Promoter stating the vehicle registration number and that the vehicle is subject to these terms and conditions as a demonstrator vehicle;
  • the Competition Winner shall, without limitation, pay promptly all bridge tolls, congestion charges and any fines (fixed or otherwise) or penalties in respect of parking, driving or similar offences incurred in connection with use of the vehicle during the usage period (including, without limitation, any fines that are sent to the Promoter.  The Competition Winner will be responsible for paying these fines);
  • the Competition Winner shall not do anything in respect of or in connection with the vehicle which may contravene relevant road traffic acts or any other applicable legislation. Failure to settle fines promptly (and within the period specified in the notice) will result in an administration of charge of £25 + VAT (up to a maximum of £100 + VAT per fine) each time the Promoter is required to contact the Competition Winner when the latter misses a deadline. The Competition Winner will be responsible for any increase in costs arising out of any delays they cause;
  • the Competition Winner is not permitted to smoke or allow anyone else to smoke in the vehicle comprising the Main Prize and shall comply with the requirements of applicable no smoking laws and regulations, and shall be liable for any proven claims which may be brought against the Competition Winner pursuant to any such legislation;
  • at the end of the usage period, upon the return of the vehicle, all sets of keys provided to the Competition Winner must be handed to the collection driver and should under no circumstances be left unattended. If the Promoter is unable to collect the vehicle on the agreed date, the Promoter shall be entitled to charge a late return fee of £51.94 + VAT per day that the return of the vehicle is overdue. The vehicle must be returned to the Promoter in a clean and roadworthy condition, both internally and externally, allowing for fair wear and tear during the period of use. Any damage identified by the Competition Winner at the time of collection must be recoded on the 'Collection Advice Notice' and signed by both the Competition Winner and the Promoter's agent. The Competition Winner will be responsible for all reasonable and proven costs associated with returning the vehicle to the condition matching that at the beginning of the usage period (fair wear and tear excepted). The Promoter reserves the right to require the Competition Winner to pay for the reasonable and proven cost of any required repairs where the vehicle has been subjected to unreasonable or unauthorised use or abuse, which shall be paid by the Competition Winner  within 14 days of receipt of the invoice;
  • the Competition Winner accepts that the Promoter gives no warranty of any nature relating to the vehicle other than the standard manufacturer's warranty applicable to the vehicle. To the fullest extent permitted by law, the Promoter excludes all warranties, conditions or other terms implied by statute or common law; and
  • the Competition Winner  will be required to produce a valid form of government issued ID on request by the Promoter.

45. The Voucher is subject to the following terms and conditions:

  • the Voucher standard terms and conditions shall apply. Please visit https://planetjunko.com/policies/terms-of-service for further information;
  • vouchers will either be sent to the relevant winners at the email address provided by those winners to the Promoter;
  • Vouchers will be valid for twelve (12) months only.Once expired, the Voucher will be invalid and cannot be extended.  Any unused credit will be lost on expiry of the Voucher;
  • Vouchers are not replaceable and, if lost or stolen, no refund will be given;
  • if Vouchers are used by way of part-purchase of an item or items of greater value than the value of the Voucher, the relevant winner will be responsible for any costs over and above the value of that Voucher; and
  • the Promoter will award the Vouchers as described in these terms and conditions however the Promoter accepts no responsibility or liability for use of the Vouchers by the relevant winners.

46. The prize(s) are non-transferable and non-refundable.

47. There is no cash alternative.

48. The Promoter reserves its right to substitute any prize with a prize of equivalent value in the event of circumstances outside of its control.

49. The Promoter reserves its right (but is not obliged) to substitute any prize for a prize of equivalent or greater value in the event of circumstances that make this necessary.

Publicity

50. By entering into the Promotion, you that the Promoter may publish, use, edit, alter and duplicate the entry, including without limitation by reposting the entry.   

51. Any Winner may be required to take part in non-paid publicity or advertising relating to the Promotion, which may include having their photograph taken for promotional and/or press purposes.

General

52. The Promoter’s decision is final.

53. It is the responsibility of the winner to adhere to any applicable health and safety guidelines.

54. The surname and county of the Winners and the prizes won will (unless the Winner has objected on lawful grounds) be made available on receipt of a self-addressed pre-paid envelope received by the Promoter at Volkswagen CRM Team, Volkswagen Group UK Ltd, Yeomans Dr, Blakelands, Milton Keynes MK14 5AN for sixty (60) days following the end of the Promotion Period.  Participants can object to disclosure, or request that disclosure be limited in scope by contacting Volkswagen CRM Team, Volkswagen Group UK Ltd, Yeomans Dr, Blakelands, Milton Keynes MK14 5AN. The Promoter may nevertheless disclose the information to the Advertising Standards Authority if required to do so.

55. The Promoter reserves the right to alter, amend, foreclose or withdraw the Promotion and/or the terms and conditions of entry at any time and without prior notice.

56. If the Promoter fails to or delays in enforcing any of these terms, that will not constitute a waiver of the Promoter's rights nor prevent the Promoter from taking steps to enforce any of these terms or its rights at a later date.

57. If there is a conflict in the terms conditions to this Promotion with any other terms whatsoever attached to any other advertising material in respect of this draw, these conditions will apply.

59. The Promotion and these Terms (including any non-contractual disputes or claims arising out of them) are subject to English law and any disputes or claims must be referred to the English courts.  Consumers in Scotland and Northern Ireland may bring action in their home court.
