Volkswagen New Car Stock Reservation Request Scheme 

TERMS AND CONDITIONS

These terms ('Terms') apply to you when you: 

  • Request to reserve a new stock vehicle through our New Car Stock Locator tool at volkswagen.co.uk;  

Please note that the reservation request is only available on selected vehicles included within the Site.  If you are interested in a specification or vehicle that is not available to reserve on the Site, then please speak directly to your local Volkswagen Retailer.  

Please read these Terms carefully before you complete your reservation request. 

When you request to reserve a vehicle through our online reservation request scheme, you confirm that you accept and will comply with these Terms. If you do not accept these Terms, then you should not request to reserve a vehicle.

1. Who We Are 

1.1 This reservation request scheme is operated by Volkswagen a trading division of Volkswagen Group United Kingdom Limited ('we', 'our' or 'us', as applicable). Our registered office address is at Yeomans Drive, Blakelands, Milton Keynes MK14 5AN. Our registered company number is 514809 and our VAT registration number is 217990930.

2. Request to reserve a vehicle

2.1 The Site includes a New Car Stock Locator tool that allows you to search for your desired specification vehicle from vehicles that may be available nationwide.  If a vehicle meeting your search criteria is available, you will be able to request to reserve the vehicle. This vehicle will then be made unavailable for a request to reserve on the Site for a period of 2 days following the date you complete your reservation request submission for that vehicle (the "Reservation Period").  A Retailer will contact you about the vehicle and confirm your reservation request. Once your request to reserve has been made, it will not be hidden from the Site (such that is unable to be viewed by other customers), but a "Reserved" label will be applied to the listing and other customers will not be able to request to reserve the same vehicle. Please note, no "holds" will be placed on the car in the vehicle ordering system. It is, therefore, possible your vehicle may be offered to other customers and may be sold during the Reservation Period. 

2.2 The vehicles displayed on the Site are not updated in real time and so it is possible that you may reserve a vehicle which may already be subject to other enquiries or reservations or may have already been sold by Volkswagen Retailer or is otherwise not available. In this instance, your Volkswagen Retailer will respond to your reservation request accordingly, making you aware of alternative vehicles that are available.  

2.3 A reservation request made through the Site does not guarantee the vehicle will be available for sale.  If you request to reserve a vehicle already sold by Volkswagen Retailer or which is otherwise not available, your Volkswagen Retailer (as appliable) will contact you by email or telephone to make you aware and offer alternative available vehicles.

2.4 Please note that the display of vehicles and search results on the Site, and your use of the tool to request to reserve a vehicle is not an order to purchase and/or a contractual sale of the vehicle that has been requested to be reserved or has been reserved. You will need to place an order to purchase the vehicle with your chosen Volkswagen. Your chosen Volkswagen Retailer will either contact you on the day and timeslot you have selected on the Site for a call or wait for you to attend your scheduled appointment to progress your purchase. 

2.5 The sale agreement for any vehicle reserved is not concluded on the Site and you will need to visit the applicable Volkswagen Retailer to make your purchase.  The purchase process will start when you attend your scheduled appointment with the Volkswagen Retailer.  If you decide to purchase the reserved vehicle, the agreement for the purchase of the vehicle will be between you and the applicable Volkswagen Retailer. We (Volkswagen Group United Kingdom Limited) do not enter into these agreements and, as we are not a party to them, do not have any obligations under them. 

2.6 Please see section 7 below for more information on the ordering process for the reserved vehicle. 

2.7 Customers who use our request a reservation tool to secure access to reserve their vehicle under these Terms are referred to as 'Customers' in these Terms. 

2.8 Please note that the display of vehicles and search results through the Site, and your use of the tool to request to reserve a vehicle (a) does not create a contract or other binding obligation between you and Volkswagen or you and a Volkswagen Retailer (as applicable); and (b) is not a vehicle order or an offer capable of acceptance.  

2.9 While we endeavour to ensure that information is accurate on the website, it is always possible that errors may occur. VED and other rates may change from time to time, and this may affect pricing. Prices are otherwise subject to change at any time. Always confirm prices and specification with your chosen Volkswagen Retailer prior to ordering. We cannot (and Volkswagen Retailers cannot) accept responsibility for your reliance on information contained on the website.

3. Eligibility 

3.1 Consumers and/or traders aged 18+ who are resident in the United Kingdom and who request to reserve a vehicle using the Site are eligible to participate in the reservation request scheme under these Terms.  

3.2 Reservations are non-transferable. The individual that made the reservation request must be the individual who places an order for the vehicle, enters into the purchase agreement with the Volkswagen Retailer and ultimately takes ownership of the vehicle.

3.3 You can reserve a maximum of one (1) vehicle through the New Car Stock Locator Tool at any time.

3.4 You agree not to use the reservation request scheme or any features on the Site for any re-sale purposes. Reservation requests deemed to be made with the intent to re-sell will make the reservation request void. 

5. Your reservation request

5.1 The Site includes a New Car Stock Locator tool that allows you to search for your desired specification vehicle from vehicles that may be available nationwide.  If a vehicle meeting your search criteria is available, you will be able to request to reserve the vehicle.

5.2 The following steps have to be taken before your reservation is confirmed:

(a)     Applying. Visit the Site and complete your reservation request with your personal details, selected retailer and other information requested on the form and press the "Request Reservation" button;    

(b) Acknowledgement of your reservation request. Once you have submitted your reservation request, you will receive email acknowledgement (to the email address provided) that your reservation request has been received and shared with the selected Retailer, along with details of the vehicle specification and finance preference for the vehicle you have requested to reserved.  

5.3 The Volkswagen Retailer will contact you by email or telephone to confirm if the vehicle you requested to reserve is still available and to set up an appointment for ordering the vehicle.

5.5 The vehicle will only be removed from the Site when you have purchased it (i.e. when you have entered into an agreement for purchase of the vehicle from your chosen Volkswagen Retailer).

5.6 If we are unable to grant you access to the reservation request scheme; for example, but without limitation, the vehicle is no longer available; the reservation request scheme is no longer available; the limit on reservation requests has been met; or this scheme has been cancelled; your Volkswagen Retailer will inform you of this by email.   

7. Vehicle Order and Purchase Agreement

7.1 If you have requested to reserve a vehicle under these Terms, then you will be able to place your order with a Volkswagen Retailer for the vehicle you have reserved. Confirmation of your order for the vehicle will be when the final purchase agreement is signed.

7.2 To purchase the vehicle you have requested to reserve, you will need to visit your chosen Volkswagen Retailer (i.e. the retailer that you selected to as part of the reservation process) to enter into the relevant agreement(s). A representative of your chosen Volkswagen Retailer will provide and discuss with you the terms of the contract for the purchase of the vehicle and, if you decide to proceed with the purchase, the contract will be entered into with the relevant Volkswagen Retailer (and not with us).  It is exclusively up to the Volkswagen Retailer to provide you with all the pre-contractual information about the vehicle.  Please address any queries or issues to the Volkswagen Retailer.  

7.3 In the unlikely event that the vehicle you requested to reserve is different to that which you reserved, or if there is an error in the pricing or the price changes, then you will be notified of this and are free to amend before proceeding with your order.  

7.4 Lead times for vehicles that are ordered may vary. Time of delivery may be impacted by different factors, such as demand and your order's position in the queue. Customers will be advised of likely lead times by the applicable Volkswagen Retailer on placing their order for the vehicle. After placing an order for the vehicle, customers will be updated on progress by their Volkswagen Retailer. 

8. Termination of the reservation request scheme 

8.1 We may close the reservation request scheme to new applicants for any reason at any time. We will endeavour to provide notice on the Site before closing access to the scheme.

9 Our Liability to You 

9.1 We are under a legal duty to provide a reservation request scheme that conforms to the description on the Site and in these Terms. We will provide the reservation request scheme with reasonable skill and care.

9.2 We are responsible for foreseeable loss or damage caused by us. If we fail to comply with our obligations to you under these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into a contract on the basis of these Terms.

9.3 We are not liable for business losses. You agree not to use the reservation request scheme or any features on the Site, for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

9.4 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. We therefore do not in any way exclude or limit our liability under or in connection with any contract with you based on these Terms for: 

  • 9.4.1 death or personal injury caused by our negligence;
  • 9.4.2 fraud or fraudulent misrepresentation;
  • 9.4.3 any matter for which it would be illegal for us to exclude or attempt to exclude our liability.

10. Other important terms 

10.1 Site availability and terms of use. We try to make the Site and the reservation request scheme available at all times, but, of course, due to the inherent nature of online and internet based services, we cannot guarantee this. 10.2 Getting advice about your consumer rights. If you are a consumer, you have legal rights in relation to services that are not provided with reasonable skill and care or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.

10.3 We may transfer this agreement to someone else. We may transfer our rights and obligations under these Terms to another organisation within our group. 

10.4 You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these Terms to another person if we agree to this in writing.

10.5 If a court finds part of these Terms illegal, the rest will continue in force. Each of the sections of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining sections will remain in full force and effect.

10.6 Which laws apply to these Terms and where you may bring legal proceedings. These Terms are governed by the law of England and Wales, and we and you can bring legal proceedings in the English courts. Nothing in this section 10.6 shall deprive you of the right to bring or defend proceedings in your home state nor of the protection afforded to you by the mandatory rules of law of the country in which you live. For example, residents of Northern Ireland can bring legal proceedings in either the Northern Irish or English courts.

10.7 Reliance on these Terms. We intend to rely on these written Terms and any document expressly referred to in them in relation to their subject matter. We and you will be legally bound by these Terms. 

10.8 We are not responsible for delays outside our control. If we are prevented or delayed from complying with our obligations under these Terms by anything you (or anyone acting on your behalf) does or fails to do, or as a result of events or circumstances beyond our reasonable control, our inability or delay in performing our obligations will not be deemed to be in breach of contract.

10.9 References to 'including' and other similar expressions. In these Terms, words that appear after the expression 'include', 'including', 'other', 'for example', 'such as' or 'in particular' (or any similar expression) will not limit the meaning of the words appearing before such expression.

10.10 "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.

10.11 Waiver. If you breach these Terms and we choose to ignore your breach, or if we delay in taking steps against you, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms again.

Models shown and information provided (including standard equipment) reflect the specification for the current model year, which is the product currently available for order from the factory.  Information may differ from what you have ordered if, for example, you ordered before the change in model year or you ordered a vehicle from stock.  Vehicles available for purchase from stock and those shown within the 'Stock Locator' tool may have a different specification, from a previous model year.  Please contact your chosen retailer for details.
